Landlord's insuranceand the pool you do not swim in.

A rental with a pool is a liability you own and do not supervise. Someone else controls the gate, the guests and the alcohol, and the claim still arrives at the owner.

An attractive nuisance does not care who the tenant is. The owner is generally drawn in regardless.

Common Issues We Solve

What a Scottsdale rental property asks of a policy

Three things about owning water you never see.

The owner is named even when the tenant was responsible

A drowning or serious injury claim typically names the property owner alongside the occupant. Whether you were present, and whether the tenant invited the person, is argued afterwards. The liability limit on the landlord policy is what stands there while that happens.

Barrier requirements are a legal condition, not advice

Arizona imposes pool enclosure requirements on residential property. A non-compliant barrier is evidence in a claim and can affect both liability and insurability. On a rental the owner cannot verify the gate daily, which is why the condition of the fixed barrier matters so much.

Some carriers restrict pools on rentals specifically

Diving boards, slides and unfenced pools narrow the market, and a few carriers decline rental property with a pool at all. It is an underwriting question to settle before buying a property, not at the first renewal.

What Is Covered

What we check on a Scottsdale rental

The water and the fence around it.

The barrier, gate and latch condition

Fixed safety features are the owner’s responsibility and the carrier will ask.

The liability limit, and an umbrella above it

This is the exposure that most often exceeds a landlord policy limit.

Whether there is a diving board or slide

Both narrow the carrier list considerably.

FAQ

Landlord's questions from Scottsdale

My tenant has guests in the pool. Am I liable?
You can be named, and usually are. Owner liability for a pool does not depend on being present. That is why the limit on a landlord policy with a pool should be higher than the default and why an umbrella above it is worth having.
Does the lease protect me?
It helps and it does not transfer the exposure. A lease clause about pool use is useful evidence and it does not prevent an injured third party from naming the owner. Insurance is what actually responds.
Will a pool stop me insuring the rental?
Not usually, though it narrows the list, and a diving board or an inadequate barrier narrows it further. It is worth confirming insurability before buying a rental with a pool rather than discovering the market is thin afterwards.
